It is an offence to

• print, publish or distribute non-complying electoral material, including how-to-vote cards and posters, for example, by not including the name and address of the person who authorised the material or the name and place at which it was printed
• printing, publishing or distributing electoral material likely to mislead an elector in relation to the casting of a vote 
• distribute electoral material or displaying posters within six metres of the entrance to a place that people vote 
• distributing electoral material on election day that has not been registered.

Social media, including Facebook, requires an authorisation that includes the electoral participant’s name and address during the regulated period.

The address of a person means a full street address and suburb or locality that is located in Australia at which the person can usually be contacted during the day. This would include the unit number.

Anyone can register electoral material. 

An application to register electoral material on behalf of a political party must be made by the registered officer or deputy registered officer of a party.

Corflutes and posters are not required to be registered.

Corflutes and posters must comply with all other legal requirements, including the authorisation with the name and full street address of the person on whose instructions the material was printed, published, distributed or displayed.

Printed material such as corflutes and posters must also include the name of the printer and the street address of the premises at which it was printed.

Partial representations of the ballot paper are permissible as long as they are accurate.

The NSW Electoral Commission cannot provide councils with candidate contact details. Candidates that have provided contact details for public display have been published on each candidate page on the NSW Electoral Commission website. 

Councils are reminded not to schedule the first meeting of the new council until after the declaration of results are completed on 3 October 2024.
