NSW Electoral Verification Facility - privacy collection notice 

This privacy collection notice applies to the NSW Electoral Verification Facility on the NSW Electoral Commission’s website pursuant to section 53 of the Electoral Act 2017.

What information is collected?

The NSW Electoral Commission will collect the following information from the NSW Electoral Verification Facility:

  • all the information entered and submitted by the user including last name, first name, date of birth and street name
  • a unique elector identifier if the user has entered and submitted the details correctly and is enrolled in New South Wales
  • the result of the user’s query, and
  • click stream data including the user’s browser type and platform (see the Website privacy statement for more details).

How will the information be used?

The NSW Electoral Commission will use the information collected from the NSW Electoral Verification Facility for the following purposes:

  • Enable a user to check their own enrolment details,
  • Enable a user who is authorised by an elector to check that elector’s enrolment details, and
  • Enable the NSW Electoral Commission to maintain, secure and improve its websites (see the Website privacy statement for more details).

Who are the intended recipients of the information?

A limited number of NSW Electoral Commission staff and contractors will have access to the information collected from the NSW Electoral Verification Facility form, for example system developers and database administrators.

The NSW Electoral Commission may disclose user information if lawfully required and may also do so in other cases where lawfully authorised, for example, to other investigative agencies for law enforcement purposes.

Is providing the information compulsory?

As there is no legal requirement to use the NSW Electoral Verification Facility, this means use of the form is entirely voluntary. For security reasons, a user must enter details in all the fields exactly as they appear on the Australian Electoral Commission’s (AEC) electoral roll to be able to submit a query.

A user is required to use the NSW Electoral Verification Facility to sign up to the election reminder service. A user does not have to sign up to the election reminder service to use the NSW Electoral Verification Facility (see the Election reminder service - privacy collection notice for more details).

If a user does not want to use the NSW Electoral Verification Facility, an equivalent online form is available on the AEC’s website. Alternatively, a user may telephone the NSW Electoral Commission to check enrolment information about themselves.

Can the information be amended?

Electors are required by law to keep enrolment details up to date. If the results of the user’s query are not correct, electors can make an application to update their enrolment details via the AEC’s website.

If a user has entered and submitted incorrect details when using the NSW Electoral Verification Facility, that user will not be able to confirm enrolment details. The information collected by the NSW Electoral Commission from the NSW Electoral Verification Facility cannot be amended once a query is submitted but a user can resubmit the form with the correct details.  

If a user has entered details correctly when using the NSW Electoral Verification Facility but is unable to confirm enrolment details, this may be because recently updated enrolment details are yet to be reflected on the electoral roll managed by the AEC, or the query relates to a silent elector.
