Expression of interest (EOI) portal - privacy collection notice

What is the EOI Portal?

The Expression of Interest (EOI) Portal is an online platform for use by individuals who want to express their interest in working at a specific election. It is accessible from the NSW Electoral Commission’s website. 

Individuals using the EOI Portal are issued a new login and password for each election event they register for.

If an individual who submits an EOI via the EOI Portal is subsequently offered employment, they are employed on a casual basis.

The roles available via the EOI Portal are generally limited to election official roles located in voting centres and election manager offices.

Most roles available via the EOI Portal are for one day only, being election day, but may range from half a day to up to 12 weeks.

This privacy collection notice only applies to information collected through the EOI Portal. It does not apply in circumstances where staff are employed otherwise than through the EOI portal. 

Submitting an EOI via the EOI Portal is not an offer of employment.  

What personal information and health information do we collect via the EOI Portal?

When you sign up to the EOI Portal we will collect your personal information such as your full name, address, contact details and date of birth.

When you use the EOI Portal we will be using cookies and keeping records of your visits to the portal. Please refer to our Website privacy statement for details.

When you save the progress of your EOI, we will collect all the information entered in the saved EOI, but it will not be considered complete and will not be forwarded for consideration.

When you submit an EOI we will collect all the information submitted via the EOI Portal which will include personal information and health information such as your employment history, role preferences and employment related declarations.

If your EOI results in an employment opportunity being offered by us, you will be required to provide additional personal information via the portal such as emergency contacts, payroll data, drivers licence details, car registration and insurance details for those roles that require use of a personal vehicle.

Why do we collect your personal information and health information via the EOI Portal?

We may use your information collected from the EOI Portal to:

  • enable us to carry out our responsibilities as an employer,
  • assess your suitability for employment,
  • make decisions with respect to your EOI, including opportunities to assist culturally and linguistically diverse (CALD) electors in particular voting venues,
  • verify your identity and enrolment status as an elector,
  • manage your portal access,
  • contact you about your EOI (including via SMS or email), 
  • report on diversity employment outcomes (statistical information only), and
  • maintain, secure and improve our websites and enhance your experience when using them.

We may also use your information, but only with your consent, to:

  • contact you in the future about any upcoming employment opportunities,
  • contact you for the purpose of surveys regarding your EOI and/or employment,
  • assist other electoral agencies for purposes relating to employment with those agencies.

The NSW Electoral Commission may receive a large volume of EOIs via the EOI Portal and may not be able to offer employment to all individuals who have submitted an EOI. The NSW Electoral Commission will consider EOIs submitted through the EOI Portal up until election day and following election day and may contact individuals who submitted EOIs for a particular election until all the work associated with that election has been completed.

Who will access your personal information?

A limited number of NSW Electoral Commission staff and contractors will have access to the information you enter via the EOI Portal where there is an identified business need to do so. 

With your express consent, we will share names and contact details with other electoral agencies for work opportunities. 

If your EOI results in an employment opportunity, the NSW Electoral Commission will disclose necessary information relating to your employment to:

  • the Australian Taxation Office (ATO) for taxation purposes,
  • your nominated superannuation fund (or our default fund in the absence of a nomination by you) for superannuation purposes, 
  • your nominated emergency contacts in the event we have concerns for your well-being or safety, 
  • Insurance and Care NSW (icare) in relation to the reporting and administration of a workers compensation matter.

We will disclose your information to other persons or entities if we are lawfully required and may also do so in other cases where we are lawfully authorised, for example, to other relevant investigative agencies for law enforcement purposes.

Are you required to provide us the information we collect?

You are not legally required to provide the information collected through the EOI portal. However, not supplying all of the information requested will delay or prevent the processing of your EOI. 

You are not required to disclose to the NSW Electoral Commission information concerning a spent conviction.

When submitting an EOI via the EOI Portal, you will not be able to progress to the next section of your EOI if you have failed to complete a mandatory field. 

Whilst some fields in the EOI Portal are not mandatory, if you do not provide the information requested, the NSW Electoral Commission may not be able to:

  • carry out its responsibilities as an employer, which in turn may have consequences on your eligibility for employment with the NSW Electoral Commission,
  • offer you an opportunity to assist culturally and linguistically diverse (CALD) electors in particular voting venues, if relevant.

Under section 54 of the Government Sector Employment Act 2013, employment may be made subject to conditions notified to the employee. All persons expressing an interest to work for the NSW Electoral Commission as an election official via the EOI Portal are required to make a declaration concerning for example political neutrality and acknowledge that all roles via the EOI Portal may involve manual handling. If your EOI is considered, you may be contacted and required to provide additional information to the NSW Electoral Commission concerning for example your employment history and declarations.

The EOI Portal is the only method by which expressions of interests can be made for a particular election but is not the only source the NSW Electoral Commission uses for the employment of staff. The NSW Electoral Commission posts a variety of roles on the NSW Government’s website ‘I Work for NSW’. The NSW Electoral Commission also engages contingent labour suppliers for the fulfilment of a variety of roles. These roles are separate to the roles offered via the EOI Portal and are located at head office and centralised counting centres.

Can you access or amend the information you provide us?

After you submit an EOI via the EOI Portal (or if you did not complete your EOI) you may log back into the portal to access and amend the entries you made, including your contact details.  

Your EOI is only applicable in relation to a specific election event. Once that event is over you will no longer be able to access or amend your EOI from the portal.

You will be provided with a unique Login ID (that is only relevant for a specific election event). You cannot amend your unique Login ID, full name and date of birth.

Once you submit an EOI via the EOI Portal, you cannot delete your EOI but you may withdraw it from consideration.
